Terms of Service
1. Acceptance of these Terms
By submitting your email, joining the waitlist, taking the phone habit quiz, receiving your phone habit profile, or using the OFF/ON website, you agree to these Terms of Service.
If you do not agree with these Terms, please do not use the Service.
The Service is currently operated by Fabrice Pittet, trading as OFF/ON® and Master Your Digital Habits®.
OFF/ON Labs SA may become the operator of the Service once incorporated in Switzerland. If this happens, OFF/ON Labs SA will continue operating the Service under these Terms, unless we notify you of material changes.
No new action will be required from you unless the change materially affects your rights or the way the Service is provided.
2. Description of the Service
The current Service consists of:
- a waitlist for OFF/ON;
- a phone habit quiz;
- a personalized phone habit profile;
- a 7-day starter plan delivered by email;
- early-access emails about the OFF/ON app.
The OFF/ON app is planned to launch first in the United Kingdom, with progressive availability in other jurisdictions.
The app may include separate free and paid features. Before the app launches, additional or updated terms may apply, including app-specific terms, subscription terms, cancellation terms, and app store terms.
3. Eligibility
You must be 18 years or older to use the Service.
By using the Service, you confirm that you meet this requirement.
The Service is not intended for minors, and we do not knowingly collect personal data from anyone under 18.
4. Your use of the Service
You agree to:
- provide an email address that you own or are authorized to use;
- use the Service only for lawful purposes;
- not misuse, disrupt, scrape, reverse-engineer, or attempt to access the Service by automated means;
- not attempt to access data belonging to other users;
- not resell, redistribute, or commercially exploit the content we provide without written permission;
- not misrepresent your relationship with OFF/ON.
We may suspend or terminate access if you violate these Terms or misuse the Service.
5. Intellectual property
OFF/ON® and Master Your Digital Habits® are registered trademarks of Fabrice Pittet.
All content, including the phone habit quiz, phone habit profiles, 7-day starter plan, emails, copy, design, methodology, scoring logic, and coaching materials, belongs to us or our licensors.
You may use the content for your own personal, non-commercial purposes only.
You may not copy, reproduce, translate, redistribute, resell, publish, or commercially exploit OFF/ON content without prior written permission.
6. Not a medical or therapeutic service
OFF/ON is a coaching and behavioral support service.
It is not a medical device, therapeutic service, mental health service, or substitute for professional healthcare.
The Service is not intended to diagnose, treat, cure, or prevent any medical or psychological condition, including anxiety, depression, addiction, ADHD, sleep disorders, or any other mental or physical health condition.
If you are experiencing distress, dependency, mental health symptoms, or any medical concern related to your phone or digital device use, you should consult a qualified healthcare professional.
7. No guarantee of results
OFF/ON is designed to help you reflect on and improve your phone habits.
We do not guarantee specific results, improvements, behavioral changes, productivity gains, health outcomes, or app availability.
Your results may vary depending on your personal situation, consistency, environment, and choices.
8. Waitlist and early access
Joining the waitlist does not guarantee access to the OFF/ON app at a specific date.
Access may be limited, phased, or prioritized by device type, geography, technical constraints, or product readiness.
We may change launch timing, features, availability, pricing, or eligibility at any time.
9. Privacy
Your use of the Service is also governed by our Privacy Policy.
The Privacy Policy explains what personal data we collect, why we collect it, who we share it with, how long we keep it, and what rights you have.
10. Third-party services
The Service may rely on third-party providers for email delivery, hosting, analytics, advertising measurement, waitlist management, quiz infrastructure, or app distribution.
We are not responsible for the availability, security, or terms of third-party services, except where required by applicable law.
11. Limitation of liability
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available."
We do not guarantee that the Service will always be available, uninterrupted, secure, error-free, or suitable for your specific needs.
To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, punitive, or business-related losses, including loss of data, loss of profits, loss of business, emotional distress, or inability to access the Service.
For the waitlist and free Service, our total liability is limited to the amount you paid to us for the Service, which is currently zero.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for fraud, intentional misconduct, or death or personal injury caused by negligence.
12. Termination
You may stop using the Service at any time.
You may unsubscribe from emails using the unsubscribe link in any OFF/ON email or by contacting us directly.
We may suspend, limit, or terminate access to the Service if:
- you violate these Terms;
- your email address is invalid or repeatedly bounces;
- you misuse the Service;
- we discontinue the Service;
- legal or technical reasons require it.
Termination removes you from future communications. We may retain limited records where required for legal compliance, security, or to respect unsubscribe requests.
13. Changes to the Service or Terms
We may update the Service or these Terms from time to time.
The current version of the Terms will be available on the OFF/ON website.
If we make material changes, we may notify subscribed users by email where appropriate.
Continued use of the Service after the effective date of updated Terms means you accept the updated Terms.
14. Governing law and jurisdiction
These Terms are governed by the laws of Switzerland, without regard to conflict-of-law rules.
Any dispute arising from or related to these Terms or the Service shall be submitted to the courts of the Canton of Vaud, Switzerland, subject to any mandatory consumer protection rights you may have under the laws of your country of residence.
Nothing in these Terms limits your mandatory statutory consumer rights under applicable law.
